These Terms apply when you use kinnfertility.co.uk or purchase products from Kinn Fertility Ltd (“KINN”, “we”, “us” or “our”). Please read them before placing an order.

Who can order

You must be at least 18 years old and legally capable of entering into a contract to place an order with KINN. KINN products are intended for adults and must be used in accordance with the product label and instructions supplied.

Product information

We take reasonable care to make product descriptions, ingredients, quantities, images and other information accurate. Packaging and presentation may vary from images shown, provided this does not materially alter the product you purchased.

Always check the label and product information supplied with your order before use, particularly if you have allergies, intolerances, take medication or use other supplements.

Health and fertility information

Information on this website is provided for general information about KINN, nutrition, supplementation and male fertility. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease or fertility condition.

KINN does not replace a semen analysis, medical assessment, prescribed treatment or advice from an appropriately qualified healthcare professional. If you have a medical condition, take medication, are undergoing fertility treatment or have concerns about your fertility, seek appropriate professional advice before using supplements.

Research discussed on the website may report changes in semen parameters or other outcomes. Individual results vary and no supplement can guarantee conception, pregnancy or live birth.

Orders and contract formation

When you place an order, you are offering to buy the products in your basket. You will receive an order acknowledgement, but this does not necessarily mean we have accepted your order.

A contract is formed when we confirm that your order has been accepted or dispatched, whichever occurs first. We may decline or cancel an order before acceptance where, for example, a product is unavailable, there is an obvious pricing error, payment cannot be authorised, or we reasonably suspect fraud or misuse.

If we cancel after taking payment, we will refund the relevant amount.

Prices and payment

Prices are shown in pounds sterling unless stated otherwise. Any applicable taxes and delivery charges will be shown before you place your order.

Payment must be made using one of the methods offered at checkout. Payments are processed securely through Shopify and/or our payment providers. We do not ordinarily receive or store your full card details.

Delivery

Available delivery options, estimated timescales and charges are shown at checkout before you place your order.

We will take reasonable steps to deliver within the stated timeframe. If no specific delivery period is agreed, we will deliver without undue delay and no later than 30 days after the contract is formed, unless a different period has been agreed with you.

Your right to cancel

If you are a UK consumer buying online, you generally have the right to cancel your order within 14 days after the day you receive the goods, subject to statutory exceptions.

To cancel, tell us clearly by emailing hello.kinnfertility@gmail.com within the cancellation period. After cancelling, you must normally send the goods back within 14 days.

Returns

Products returned following a change of mind must be handled with reasonable care. For health and hygiene reasons, we may be unable to accept a return of sealed goods once the seal has been broken where the statutory health-protection or hygiene exception applies.

This exception does not affect your legal rights where goods are faulty, damaged, not as described or otherwise fail to meet the standards required by law.

Refunds

Where you validly cancel an online order, we will refund payments due under applicable consumer law, including standard outbound delivery where required. We may wait until we receive the returned goods or evidence that you have sent them back before issuing a change-of-mind refund.

Refunds will normally be made using the original payment method unless agreed otherwise.

Faulty, damaged or incorrect goods

Your statutory rights are not affected by these Terms. Goods must be as described, fit for purpose and of satisfactory quality.

If your order arrives damaged, incorrect or faulty, contact us as soon as possible with your order details. Depending on the circumstances and your legal rights, we will arrange an appropriate remedy such as a refund or replacement.

Promotions and discount codes

Promotions, founding-member offers and discount codes may be subject to additional conditions stated at the time. Unless stated otherwise, offers cannot be exchanged for cash and may be withdrawn or amended where reasonably necessary before an order is placed.

Intellectual property

The KINN name, branding, website design, graphics, copy and other original content are owned by or licensed to Kinn Fertility Ltd unless otherwise stated. You may use the website for personal, non-commercial purposes but may not reproduce or commercially exploit our content without permission.

Third-party links and research

We may link to scientific papers, public bodies or other third-party websites. These links are provided for reference. We do not control third-party websites and are not responsible for their content, availability or privacy practices.

Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to those rights, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer.

Changes to these Terms

We may update these Terms from time to time. The Terms in force when your order is placed will apply to that order.

Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the UK, you may also have rights to bring proceedings in the courts of the part of the UK where you live.
